1. Agreement to Terms

Welcome to the Horace Mann Club platform, a benefits and engagement platform for eligible educators (the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not access or use the Platform.

These Terms constitute a legally binding agreement between you and Horace Mann Service Corporation, or its applicable affiliate(s) ("Horace Mann," "we," "us," or "our") governing your access to and use of the Platform, related services, and content.

2. Eligibility

To use the Platform, you must:

• Be at least 18 years of age
• Be a current educator
• Have the legal capacity to enter into a binding agreement
• Provide accurate, current, and complete information during registration

3. Account Responsibilities

When you create an account, you agree that:

• You are responsible for maintaining the confidentiality of your login credentials
• You are responsible for all activity that occurs under your account
• Your account and associated benefits are for your personal use only and may not be shared
• We may suspend or terminate your account if these Terms are violated

4. Use of Benefits

When using benefits available through the Platform:

• Benefits may not be resold, transferred, or shared
• Benefits are offered by third-party providers and are subject to their separate terms and conditions
• Horace Mann acts solely as a facilitator and does not guarantee third-party products, services, availability, or performance
• Benefit offerings may be modified, replaced, or discontinued at any time

5. Prohibited Conduct

You agree not to:

• Use the Platform for unlawful, fraudulent, or unauthorized purposes
• Attempt to gain unauthorized access to systems, accounts, or data
• Interfere with or disrupt Platform operations or security
• Upload or transmit malware, viruses, or harmful code
• Impersonate any person or entity

6. Intellectual Property

All content on the Platform, including text, graphics, logos, software, and trademarks, is owned by Horace Mann or its licensors and is protected by applicable intellectual property laws.

7. Privacy

Your use of the Platform is subject to our Privacy Policy, which describes how we collect, use, and protect personal information. By using the Platform, you consent to our data practices as described in that policy.

8. Disclaimers

To the fullest extent permitted by law, we disclaim all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement. We do not guarantee uninterrupted, error-free, or secure access, nor do we guarantee third-party benefit performance or outcomes.

9. Limitation of Liability

To the maximum extent permitted by law, Horace Mann shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Platform or benefits.

10. Indemnification

You agree to indemnify and hold harmless Horace Mann and its officers, directors, employees, affiliates, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of applicable law or third-party rights
• Any false or misleading information you provide

11. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated through the Platform or by other reasonable means. Continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.

12. Termination

We may suspend or terminate your access to the Platform if you violate these Terms, are no longer eligible, or misuse the Platform. Upon termination, your right to access the Platform will cease.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration in Illinois, except that either party may seek injunctive relief in a court of competent jurisdiction.
